It depends. It is technically a fruit, but in 1893 the US Supreme Court ruled that while physiologically it is a fruit, by use it is and can be considered a vegetable.

Well, according to our friends at the California Tomato Growers Association Inc.: "technically a tomato is a fruit, since it is the ripened ovary of a plant.
